Dear Hr." Eogacko:
This leU:er refers to concerns you expressed to the Nuclear Regulator'y Commission '(NRC) regarding activities at the Florida Power and Light Company's St. Lucie"Nuclear Plant.
In our previous correspondence to you.
we indicated that the NRC would take appropriate measures to protect your identity and if we cou1d not that we would contact you.
I wanted to personally contact you and inform you of an error we have made in this regard, During the period of February 6 through 9, 1998, I attempted to contact you by telephone, but was unsuccessful
':n reacliing you.
Recently, the NRC received two reauests for'ocuments from the Port St. Lucie
'ews related to employee concerns at the St. Lucie plant.
The newspaper made these requests pursuant to the FreedoIII of Infqrmation Act (FOIA), which requires us to release certain Agency records to the public.
Typically. when providing these documents under the FOIA. information which could potentially identify allegers is withheld.
In processing the first of these requests.
the NRC provided information which included a description of your allegations to the NRC.
Although the
'nformation did not include your name.
we subsequentlv determined that a
knowledgeable individual at the St. Lucie site could possibly determine your identity due to the specificity of the information.
In processing the second FOIA request,,
we I'eleased various iniormation regarding your and other'llegations.
and your name was inadadvertently included in an index of documents w"Iich was provided to the newspaper.
The information released to the newspaper as part of the first FOIA was also placed in the Public Document Rooms (PDR). including the local PDR in the St. Lucie area; however, the document containing your identity was only in the PDR in Mash;ngton, D.C. for a short period before identification of this issue.
It is our understanding that the licer:see did obtain the documents which described the substance of vour allegations; however, they did not obtain the document that identified your name.. At this tive. all information related to both FOIA requests has been withdraw from the PORs:

Me have communicated directly with the licensee and the newspaper regarding tl..is matter.
The newspaoer understands the sensitivity of the information they possess and have indicated that it is not their intention to identify individuals in any manner.

They have indicated a
desire to protect the information, in fact. it was the licensee who initially notified the NRC that some information released could potentially disclose individuals 'dentities.
Enclosure 1 contains an NRC brochure "Reporting Safety Concerns to the NPC."
It includes information on the allegation process.

- Act, The responsib',e DOL office for investigation of discrimination complaints is the Occupational Safety and Health Administration (OSHA).
Mritten complaints shou1d be forwarded to DOL-OSHA.
They must describe the alleged discrimination and must be filed within 180 days of the occur. ence.
