ALLEGED DISCRIHINATION AGAINST IKC TECHNICIAN FOR RAISING SAFETY CONCERNS REGARDING CALIBRATION OF TEST EQUIPHENT (RII-96-A-0142) (OFFICE OF INVESTIGATIONS CASE NO.

2-96-027)

Dear Hr. Plunkett:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC) Office of Investigations completed report regarding alleged discrimination by Florida Power and Light against an employee for reporting safety concerns at your Turkey Point Nuclear Plant.

A complaint was filed by the employee with the U.S. Department of Labor.

OI determined that there was insufficient evidence to substantiate the allegation of discrimination.

We plan no further action with regard to this matter We will continue to monitor the outcome of the DOL activity for any potential enforcement actions that may be warranted.

SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission, Office of Investigations.

Region II, on July 9, 1996, to dethrmine whether the Florida Power and Light Company (FPL) illegally discriminated=against a former instrumentation and calibration specialist at the FPL Turkey Point Nuclear Plant.

The evidence developed in this investigation does not substantiate the allegation that FPL illegally discriminated against the employee in question.
