PROPOSEO IMPOSITION OF CIVIL PENALTV - $ 10O.OOO This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 will be issued on or about July 16, 1996, to Florida Power and Light Company.
The action is based on a Severity Level II violation involving discrimination against an engineer formerly employed by the licensee.
A letter is also being sent to the supervisor found by the Secretary of Labor to have discriminated against the
- engineer, but no formal enforcement action is planned against the supervisor since the violation occurred before the Deliberate Misconduct rule was implemented.
In accordance with the Enforcement Policy.
a base civil penalty in the amount of $80,000 is considered for a Severity Level II violation.
The staff determined that credit was not warranted for corrective action because the licensee has not reinstated the engineer as required by the order of the Secretary of Labor
. and that credit was not warranted for identification since the violation was identified by the Department of Labor.
Thus.
a civil penalty in the amount of twice the base civil penalty would normally be assessed.
However, the civil penalty has been set at the statutory limit of
$100,000 for this single violation.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:

1996 Telephone Notification of Licensee July 16, 1996 The State of Florida will be notified.
The licensee has thirty days, from the date of issuance of a Cour t of'ppeals decision on licensee's appeal of the DOL ruling in which to respond.
Following NRC evaluation of the response.
