Dear Hr. Goldberg:

By letters dated February 20,

1995, and April 6, 1995, relief was requested from certain requirements related to the second ten-year interval inservice inspection program at Turkey Point, Units 3 and 4.

Relief was requested from covering the required Code examination areas during volumetric and surface examinations due to permanent physical obstructions or other technical reasons.

In addition, a "clarification" was submitted concerning the selection of Class 1 high stress welds.

With respect to the volumetric and surface examinations, we have concluded that the Code requirements are impractical.

Therefore, having given consideration to the burden on the licensee that could result if the requirements were imposed, relief is granted for the requests for relief pursuant to 10 CFR 50.55a(g)(6)(i).

Regarding the "clarification" of the selection of Class 1 high stress

welds, we have concluded that your position requires a relief from ASHE Code requirements.

This is based on the fact that the described clarification is a

deviation from the ASHE Rules for Inservice Inspection of Nuclear Power Plant Components,Section XI, 1980 Edition with Addenda through Winter 1981, Inservice Inspection Program for the Second Ten-Year Interval, and the 1989 Edition for the third ten-year interval, specifically, the requirements of Table IWB-2500-1, Examination Category B-J, Note (1)(b).

Our conclusion that a request.for relief is needed is consistent with the fact that other licensees have submitted requests for relief from similar Code deviations.

For example, the licensees for Surry 1 and 2, Zion 1 and 2, Haine Yankee, and others have recognized that their selection criteria for Class 1 piping welds did not meet the above Code requirements and submitted requests for relief.

In all cases, the requests were authorized by the NRC staff.

In another

case, the licensee for Indian Point 2 recognized the deviation and as permitted by 10 CFR 50.55a(b),

used the 1974 Edition with Addenda through Summer 1975 as its basis for the selection of examination of Class 1 piping welds for its third ten-year interval inservice inspection program plan.

We have reviewed your position as an alternative to ASHE Code requirements.

As a result, we have'concluded that the alternative described in the "clarification" provides an acceptable level of quality and safety

and, therefore, the proposed alternative to the selection of high stress Class 1

piping welds is authorized pursuant to 10 CFR 50.55a(a)(3)(i).
