Dear Nr. Liparulo:
By your application dated January 27,
- 1995, and affidavit CAW-95-779 dated January 27,
- 1995, executed by Henry Sepp, Westinghouse submitted proprietary and non-proprietary versions of "Westinghouse Revised Thermal Design Procedure Instruments Uncertainty Methodology for Turkey Points Units 3
& 4" and requested that the proprietary version be withheld from public disclosure pursuant to 10 CFR 2.790.
The information which is proprietary in the proprietary version is contained within brackets, and where the proprietary information has been deleted in the non-proprietary version, only the brackets remain (information that was contained within brackets in the proprietary version having been deleted).
The affidavit stated that the information submitted should be considered exempt from mandatory public disclosure for the following reasons:

where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies; it consists of supporting data, including test data, relative to a

the application of which data secures' competitive economic advantage, e.g.,
by optimization or improved marketability.
its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assur ance of quality, or licensing a

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
