1992, which you submitted to my office pursuant to Section 2.206 of Title 10 of the Code i

In the Petition, you requested that the U.S. Nuclear Regulatory Commission (NRC) not permit the Florida Power and Light Company (FPL or Licensee) to resume operating the units of the Turkey Point Station until the concerns which you raise in the Petition have been addressed.

Turkey Point Unit 3 is currently in a planned refueling outage.

On October 2, 1992, the Licensee shut down Unit 4 at the request of the NRC to allow the Federal Emergency Management Agency (FEMA) to complete its verification of the adequacy of offsite emergency preparedness.

In the Petition and its addendum, you alleged a number of deficiencies with the Turkey Point units.

The alleged deficiencies include concerns with the adequacy of fire protection systems and features; adequacy of physical security systems; adequacy of design basis and technical specifications of the Turkey Point units; adequacy of the emergency diesel generators; availability of critical communication and evacuation mechanisms during events such as Hurricane Andrew; technical specification and procedural violations; the adequacy of the diesel generator loading profile; availability of sufficient workers to support the Turkey Point units; reliability of the overpressure mitigation system; need for a Failure Mode and Effects Analysis before start-up; the adequacy of data on monitored radiation, contamination and exposure from August 24, 1992, to date; interactions between the fossil and nuclear units at the site; use of FPL management safety evaluations in place of engineering packages; adequacy of safety evaluations prepared by the Licensee and concern that those safety evaluations represent a pattern of violations of the requirements of 10 CFR 550.59; and concerns about the ethics and prudence of current FPL management.

Hr. Regino R. Diaz-Robainas October 23I 1992 The NRC has reviewed your Petition, including your request that the Turkey Point units not resume operation until your concerns have been addressed.

We will provide our detailed response to the specific issues raised in your Petition within a reasonable time.

However, we have determined that certain of your concerns have previously been considered in the staff's inspections and evaluations of the Licensee's restart activities.

Our summary of the September 22, 1992 meeting with the licensee relating to Unit 2 stack damage and fire protection systems configuration is enclosed.

Our inspections are currently being documented in inspection reports which we will provide to you when complete.

Based on our review of your Petition and on the results of our inspections and evaluations of the Licensee's restart activities, we conclude that the issues raised in your Petition are not of sufficient safety significance to warrant action by the NRC to preclude restart of the Turkey Point nuclear units.

Accordingly, your request that the Turkey Point units remain shut down until your concerns are addressed is denied.

As provided by 10 CFR 52.206, the NRC will take action on the specific issues raised in your Petition within a reasonable time.
