Dear Mr. Saporito:
This letter responds to your October 30, 1989, letter reviewing the most recent Nuclear Regulatory Commission (NRC)
Systematic Assessment of Licensee Performance (SALP),
dated October 19, 1989, for the Turkey Point facility.
Your letter addressed twenty "Issues for Consideration."
Our response to the issues is delineated in the following paragraphs:

Issues 1 thru 8 question the changes in the number of SALP functional areas from the prior SALP period.
These changes were made to al'1
. evaluations conducted after 1988.
The NRC policy revisions were reflected in the then current 'NRC Manual Chapter (MC) 0516 which reduced the number of areas evaluated and increased the scope of each area.

Issues 9 thru 12 question the "improving trend" given the area of security.
Performance trends are noted when a trend exists that is discernible and continuation of the trend is expected to result in a
change in performance rating in the next assessment period.
This policy is delineated in MC 0516.
Issue 13 questions the evaluations of Licensee Event Reports (LER) in determining SALP ratings.
The NRC does not rely on LERs as the only criteria in rating the licensee's performance.
For the Engineer-ing/Technical Support area, the NRC does evaluate the general technical adequacy of these reports.
Issue 14 questions the NRC's failure to consider operating capacity factors in the SALP process.
The SALP board reviews and evaluates the licensee's overall compliance with NRC rules and regulations.
In general, we do not consider economic issues not covered by NRC rules and regulations when rating facilities.
Issue 15 questions the NRC's use of objective data in the SALP process.
The final analysis and SALP ratings determined by an NRC seven-member board are subjective;
- however, the ratings are supported by objective data.

Issues 16 and 18 question the use of past performance information (outside current SALP period) when assessing SALP ratings for the current period.
The assessment is a look at licensee performance during a specific time period and is not based on events or issues which occurred outside the appraisal period.
- However, comparisons are
- made, when appropriate, with the previous SALP report so that improvements or declining trends can be noted.

Issues 17 and 19 question whether civil penalties and repetitive violations are reviewed in determining SALP ratings.
The NRC reviews all violations, including civil penalties, which take place in the rating period when assessing the various SALP areas.
Enforcement is one of seven criteria used in determining the ratings.

Issue 20 questions whether the SALP was properly evaluated by the NRC using the evaluation criteria in Section III of the report.
It is our view that the NRC performed the assessment as specified in NRC HC 0516.
In su+nary, the NRC assessment properly reflects the performance of the facility which has shown improvement over the previous SALP period.
Please be assured that the NRC will continue to closely monitor the performance of Turkey Point to ensure performance improvements are sustained.
