DPR-31 and Amendment No.

105 to Facility Operating License No.

DPR-41 issued in support of the spent fuel pool (SFP) expansion for the Turkey Point Plant Units Nos.

3 and 4, respectively.

You stated that Region II's position was that the Turkey Point Technical Specifications (TS) should be upgraded to the level of the current STS.

You further stated that the proposed TS upgrade is based on the extended use of SFPs beyond the original design basis when the plant was licensed and the additional -TS requirements are necessary to ensure the assumptions of the staff's Safety Analysis in support of the Amendments are., not exceeded.

As you have noted in your memorandum, the amendments are the subject of a current proceeding.

The Board and parties have been noti,fied by Memorandum dated March 25, 1985 (BN-85-030),in accordance with the procedure for Board Notifications.

Me will keep the Board and" all parties informed as to the resolution of the concerns.

If The review of SFP expansions involve the technica'1 expertise of eight technical review branches in NRR.'-

Upon receipt 'of your concerns we requested that the cognizant 'review branches address, each of the concerns identified in your memorandum.

The results of. this'ffort are included in the enclosure.

In addition, we have also described in the enclosure the NRR review process in assessing the adequacy, of amendment requests for operating reactors in light of the existing License basis, the Regulations and Commission Policy and Planning Guidance; specifically in the areas of STS and backfitting.

Me have concluded, based on our review of your 'concerns detailed in the enclosure, that none of the issues raised are of significance to warrant a

backfit of the STS in relation to the referenced amendments or revision to the guidance provided in the current STS.

Further, we have concluded that the staff's Safety Evaluation and Environmental Assessment in support of the amendments adequately reflect our review and provide an acceptable basis for the Turkey Point TSs issued in support of SFP expansion.

I trust you will find that the enclosure is responsive to your concerns and provides assurance that the decisions are based on sound technical judgment 8505i5049i 850503 P
