Dear Hr. Uarga:
This is in response to your letter of December 12, 1980 regarding Florida Power and Light Company's application to amend its operating license for Turkey Point Plant Unit Nos.
3 and 4 in Dade County, Plorida.
The federally listed threatened and endangered species that were identified as possibly occurring in the area were:
West Indian manatee Amerian peregrine falcon Bald eagle Brown pelican Loggerhead turtle Green turtle Leatherback turtle Hawksbill turtle Kemp's Atlantic ridley turtle American alligator Eastern indigo snake American crocodile After reviewing the Biological Assessment, we agree with your conclusion that neither the construction nor operational aspects of the repair program will adversely impact the above listed threatened or endangered species or adversely modify Critical Habitat of the American crocodile.
There is one phase of the operational program that mas not fully discussed,

and that was the placement of the spent resin material.
As indicated in the assessment no definite decision has been made as to the disposal of this material.

If at such time the decision is made to bury onsite we should be notified as this'would constitute, in our opinion, a modification in the project.
Reinitiation of Section 7, consultation will depend on where the resin material will be buried in relation to the crocodile habitat, and any associated impacts brought about by this action. If this information is available at this time, you may forward it on to our office for review.
This does not represent a Biological Opinion as outlined in Section 7 of the Endangered Species Act, as amended.
It does however, fulfillthe requirements of the Act, and no further action on your part is required, unless there are changes made in the proposed project or if additional information becomes available on potential impacts to threatened and endangered species.
