Dear Ms. Taylor:
Your April 10, 1980 letter to Mrs. Elizabeth Bowers, regarding NRC Staff prepara-tion of an environmental impact statement (EIS) for the Turkey Paint and Surry steam generator repair actions, has been referred to me for reply. Mrs. Bowers is the presiding Atomic Safety and Licensing Board Chairman in the Turkey Point steam generator repair proceeding and thus is unable to comment on this or any aspects of that case.
Your letter questions the reason for issuing environmental impact statements for the referenced actions and requests an opportunity to meet with a member of the Licensing Board or Nuclear Regulatory Commission to dis-cuss the Turkey Point repair when one of the members is in the Miami area.
The NRC Staff prepares environmental impact statements for all construction permit and operating license applications.
The substance and nature of the NRC environmental review in other kinds of Hcensing actions depends on the particu-lar facts of a case.
The NRC Staff initiallyprepared an environmental impact appraisal in connection with both the Surry and Turkey Point repair actions in which it concluded that neither action would have a significant environmental impact so as to require issuance of an environmental impact statement under the relevant provisions of the National Environmental Policy Act. The NRC Staff deter-mination that it was.unnecessary to prepare an EIS on the Surry repair action was reversed by the full Commission on the petition of a public interest group.
A copy of that decision is enclosed.
In light of this Commission decision, and in order to eliminate the prospect of extended litigation in the Turkey Point pro-ceeding over the issue of whether an EIS should issue, the NRC Staff decided to prepare an EIS in this matter.
That statement is. under preparation.
When the statement has issued in final form, evidentiary hearings can presumably be scheduled in the Turkey Point repair proceeding.
In addition to the testimony presented by the parties to the proceeding, interested members of the public are normally permitted to enter oral or written statements concerning the action on the record at the discretion of the Licensing Board.

Because of their duty to rule upon the issues presented in the case solely upon the evidence introduced at the hearing, it would be inappropriate for the members of the Licensing Board or the Commission, which may ultimately review the deci-sion of the Board in this matter, to discuss the case publicly.
