Recently, a letter addressed to you, from Dr. Robert E.

Uhrig of'lorida Power and Light Co., dated January 23, 1980 was filed in the local PDR.

Dr. Uhrig justifies his request f'r an extension of time between steam generator inspections basically on economic grounds with rather tenuous safety arguments presented.

t th t The EIA 1 t estimates that Unit No. 4 will be derated in the Fall of 1980 due to the lack of adequate heat transfer area. Xt f'urther states that Unit No. 3 may be derated in the Fall of 1981 for the same reasons.

Table 4.2 in the EIA indicates that in 1976, radioactive noble gases released f'rom Turkey Point were 213 5 higher than PES estimates and the 1977 noble gas release was 328 gf hidher than the estimate. As the tube degradation increases, IICOI

I feel that the steam generators should come under greater scrutiny rather than lesser.

Additionally, the recently completed inspection and maintenence program on Unit No. 3 has produced the startling discovery of shattered metal fragments found in steam generators 3B'nd 3C.

The preventative tube plugging program instituted by the NRC may be the only means by which a severe incident is forestalled.

I am interested to know what criteria are used in granting or denying such requests as made by Dr. Uhrig. I would appreciate: the opportunity to address these issues at an NRC Staff hearing in Miami or if an amendment to the Operating License is at issue, I would like this letter to serve as a "PETITION FOR IZ<AVZ TO INTERVENE" Very trul yours, Mark P. ORDER RELATING TO LICENSEE'S MOTION FOR EXTENSION OF TIME On December 17, 1979, Licensee filed a document entitled "Licensee's Responses and Objections to Interrogatories to, and Request for the Production of Documents from Licensee, Florida Power and Light Company". In a response filed the same day, the Intervenor requested that the Board compel Licensee to answer cer-tain interrogatories to which Licensee had objected.

On December 21, 1979, Licensee filed a motion advising that it wished to respond to Intervenor's December 17 filing and requesting an extension of time in which to respond, to January 14, 1979. Licensee said that it planned to withdraw some of its objections, but its determination of which objections to withdraw would require recommendations from technical personnel who would not be available during the upcoming holiday season. Licensee represented that counsel for Intervenor stated that he had no objection to the extension of time, and counsel for the NRC Staff likewise has stated that he does not object.

ORDER RELATIVE TO INTERVENOR'S REQUEST FOR ADDITIONALTIME The Board ordered the Intervenor to respond by November 13, 1979, to objections by FPL to his discovery requests. On November 13, 1979, the Hoar d received a motion from the Inter-venor requesting additional time of ten days from the receipt of,the Board's order ruling on the motion for the reasons stated.

The Board. reminded. the other parties in its order of November 15, 1979, of their obligation to respond to the motion in accordance with 10 CFR 52.730.

On November 19, 1979, FPL responded that it had no objec-tion to the motion for the additional, time but expressed concern that matters proceed expeditiously toward resolution. On November 27, 1979, the NRC Staff responded that it had no objec-tion to the motion.

The motion is granted.
