Dear Members of the Board:

This refers to the telegram dated May 23,

1979, and the letter to you dated May 24, 1979, advising that Bruce S.
Rogow, Esp.

and eight. other attorneys have undertaken to represent M'ark P.

Oncavage in connection with the above entitled matter.

The communications from Mr. Rogow indicate that new counsel intends to file a "response" to the pleadings filed by Florida Power 6 Light Company and the NRC Staff in compliance with the Board's order of May 9,

1979, and an "appropriate Supplement" or a "Motion to Sup-plement."

Of course, counsel is free to file any pleading that.

complies with. the Commission's regulations, and FPL will respond to any such pleading if and when it is filed; To the extent.,

however, that the letter and telegram consti-tute a request for delay of a decision on the petition to intervene or for advance permission to file still another

The Board's order contained no provision for any response by Mr. Oncavage.

Further, no such response is necessary.

The question whether Mr. Oncavage's participa-tion would "reasonably be expected to assist in developing a sound record" was thoroughly explored at the prehearing conference when the revised list of contentions was offered, and the Board has before it all of the information neces-sary for it to rule.

It should also be 'emphasized that at the prehearing conference it was made clear that Mr. Oncavage would be represented by counsel if the petition to intervene should be granted.

Confirmation of that statement in no way changes-the situation before the Board.

Consequently, the appearance of new counsel at this late date does

not, constitute reason for delaying decision on the petition to intervene or permitting further revisions of the petition.
