Acting Licensing Support Network Administrator Information Gathering Associated with the Licensing Support Network Advisory Review Panel Meeting On August 11, 2017, Licensing Support Network Advisory Review Panel (LSNARP) Chairman Dr. Andrew Bates contacted, among others, each of those on the Yucca Mountain adjudication service list to advise that, pursuant to the Commissions direction in COMSECY-17-0019, information-gathering activities were being initiated regarding possibly reinstituting or replacing the Licensing Support Network (LSN). As Dr. Bates memorandum also explained, the goal of this information gathering is to assist the Commission in making efficient, informed decisions concerning the appropriate means for reconstituting the LSNs functionality if the currently suspended Yucca Mountain adjudication were to recommence in the future. Further, Dr. Bates memorandum indicated that an LSNARP meeting would be convened to gather input and make recommendations to the Commission regarding reconstitution of the LSN in an appropriate form.
As was the case in 1999 when the particular process for fashioning what would become the LSN was first instituted, database sizing and participant capabilities are important information items for assessing potential options for system formation and implementation. Accordingly, as an aid to the process of developing options for technical implementation solutions in the event the Yucca Mountain adjudication is reinstituted, NRC needs some specific information about potential submissions and current capabilities from those on the Yucca Mountain adjudication service list who, having made accessible via the LSN 500 or more items of documentary material or having sponsored ten or more admitted contentions, likely will utilize the LSN (or a successor system) to the greatest extent as the vehicle for additional documentary material disclosures through the close of discovery.
Additionally, consistent with 10 C.F.R. § 2.1013(c), the Yucca Mountain adjudication is intended to be conducted using the agencys E-Filing system for accepting and processing participant filings, including evidentiary hearing exhibits. Under section 2.1011(e)(2), the LSNARP is also a forum for gathering information and input regarding the procedures and standards associated with electronic filings. Accordingly, to aid the NRC in formulating options for a potentially more efficient way to have evidentiary hearing documentary exhibits submitted to, and processed within, the agencys Electronic Hearing Docket, we also are seeking information from those on the Yucca Mountain adjudication service list who, based on the extent of their involvement with LSN document submissions or admitted contention sponsorship, are likely to make the most substantial use of the LSN (or a successor system) as the source of evidentiary hearing exhibits for litigating the currently admitted contentions.
We thus request that, to the extent resources permit, each of you respond to the questions in the forms attached to this memorandum. To analyze the information provided in a timely manner for incorporation into an options analysis that will be provided to LSNARP members and participants prior to the meeting referenced in Dr. Bates August 11 memorandum, it is essential that the information requested be provided on a timely basis. Accordingly, if you wish to have your information taken into account, you are asked to respond by filling out the attached forms and returning them by e-mail by Monday, November 27, 2017.
