Dear Mr. Lieberman:

By letter dated October 13, 1998, Indiana Michigan Power Company (I&M), licensee for the Donald C. Cook Nuclear power plant, units 1 and 2, received a notice of violation and proposed imposition of civil penalty (EA Numbers98-150, 98-151,98-152, and 98-186).

The issues cited in the notice were documented in the above referenced five inspection reports.

A pre-decisional enforcement conference was held on May 20, 1998, during which we acknowledged the characterization of the apparent violations, described the assessment of root causes, and described preventive and corrective actions to address these issues. I&M will not protest the imposition of the proposed civil penalty and will remit payment in the amount of $ 500,000 within 30 days of the October 13, 1998, notice of violation.

On July 30, 1998, the NRC described the establishment of an 0350 restart panel for the plant. We have developed a detailed restart plan and strategies to achieve implementation of each of the major restart activities. The administrator of Region III, the responsible NRR directorate, and the members of the 0350 restart panel are aware of our ongoing efforts to identify the root causes of the issues enumerated in the notice and to establish effective corrective actions in connection with the efforts leading to restarts One of the major projects underway, and the one on the critical path to restart, is the complete refurbishment of the ice condensers in both units. There have been monthly briefings with the restart panel on the progress being made.

In light of the other time commitments of our management and staff, we respectfully request a 60-day extension of time within which to respond to the notice of violation.
