NRC PREDECISIONAL ENFORCEMENT CONFERENCE

SUMMARY

Dear Mr. Sampson:

This refers to the Predecisional Enforcement Conference conducted by Mr. James Caldwell, Deputy Regional Administrator, other members of the Region III staff, and Headquarters

staff, via video conference, on May 20, 1998. The subject of this conference was the apparent violations at Donald C. Cook, Units 1 and 2, identified in NRC letters dated April9, 1998 (50-315/97017; 50-316/97017), April 10, 1998 (50-315/98005; 50-316/98005), and May 7, 1998 (50-315/98004; 50-316/98004; 50-315/98009; 50-316/98009) involving breakdowns in four programmatic areas.

During the conference, your staff acknowledged the violations and presented information addressing the background, conclusions, significance, and lessons learned for each area.

These areas involved the implementation of a corrective action program to assure conditions adverse to quality are effectively corrected; the performance of test activities to assure continued availability and operability of safety systems and equipment; the control and maintenance of the facilitydesign basis; and the conduct of safety evaluations to assure facility and procedure changes do not create unreviewed safety questions.

In addition, your staff addressed operability concerns relating to the ice condenser and containment recirculation sump.

Copies of the NRC's and licensee's handouts, and the attendance list are enclosed with this summary.

You willbe notified by separate correspondence of our decision regarding the enforcement action based on the information presented and discussed at the Predecisional Enforcement Conference.

No response is required until you are notified of the proposed Enforcement Action.
