10 CFR 2.206 PETITION, DONALD'.COOK NUCLEARPLANTS UNITS 1 AND2, DOCKET NOS. 5Ml5AND50-316

Dear Mr. Callan:

The Union ofConcerned Scientists submitted a 2.206 petition dated October 9, 1997, requesting &pccific actions bc taken at the D C Cook plant prior to restart. Ihave been informed by Mr. John Hickman, D C Cook Project Manager and the Petition Manager, and by Mr. Roy P. Zanmerntan, Associated Director for Projects, that the stfdF s actions to liftthc confumatoty action letter (CAL)willalso serve to address thc actions requested in our petition. Mr. Zin1n1crman informed me that duc to administrative matters, thc CAL would probably be lifted and thc plants restarted before wc receive a formal response to our petition. Mr.

Zimmefman assured mc that the staF would contact me prior to the plant's restart to provide its basis for liNng the CAL.

The NRC's Headquarters Daily Report for January 13, 1998, provided the followinginfornurtion relevant to D C Cook:

"Followinga public meeting with thc licensee on Januaty 8, 1998, the NRC scat a special team to D. C. Cook on January 9, 1998. The purpose ofthc team is to review a sampling ofthe licensee's corrective actions in response to the Con6rmatofy Action Letter (CAL)issued on September 19, 1997. 'Bee team willalso validate thc licensee's root cause analysis and verifysome ofthe licensee's conclusions reached during their assessment ofthc CALitems. Following thc inspection, the NRC willassess thc results ofthe inspection and make a determination regarding whether or not to lift the CAL."

"The team consists ofa team leader from Region HI, a region based inspector, the former Architect Engineering (AE) Team leader from NRR and two ofthe original AE Team contractors. The inspection is currently scheduled to last approxifnately two weeks."

The restart ofthc plant reruns the actions requested in our petition moot.

Therefore, UCS respectfully requests that the NRC staffprovide me a copy ofthe special team inspection rcport, even ifit is a preliminary version subject to revision, at least one business day prior to the NRC stafF liftingthc CAL.
