1 AND 2 - RELIEF REQUEST FOR THE USE OF ASME ON-1995 FOR SNUBBER TESTING (TAC NOS.

M99158 AND M99159)

Dear Mr. Fitzpatrick:

By letter dated July 3, 1997, Indiana Michigan Power Company (IMPCo) submitted a

request to the NRC staff for approval to use the ASME/ANSI OM Code-1995, Subsection ISTD, as an alternative to the ASME Boiler and Pressure Vessel (88IPV) Code,Section XI, requirements for the third 10-year inservice snubber test program interval at the Donald C.

Cook Nuclear Plants, Unit Nos.

1 and 2, pursuant to 10 CFR 50.55a(a)(3).

Based on the information submitted, the staff concludes that IMPCo's proposed alternative to use the ASME/ANSI OM Code-1995, Subsection ISTD, in lieu of ASME BSPV Code,Section XI, requirements provides an acceptable level of quality and safety.

However, in considering that the NRC has not yet generically approved the use of the ASME/ANSI OM Code-1995, the staff concludes that an interim approval of the proposed alternative can be authorized, pursuant to 10 CFR 50.55a(a)(3)(i), pending NRC review and approval of ASME/ANSI OM Code-1995 on a generic basis.

The staff's evaluation and conclusions are contained in the enclosed safety evaluation.
