1. 0 INTRODUCTION By letters dated February 22,
1996, and July 22,
1996, the Indiana Michigan Power Company (the licensee) requested amendments to the Technical Specifications (TS) appended to Facility Operating License Nos.

DPR-58 and DPR-74 for the Donald C.

Cook Nuclear Plant, Unit Nos.

1 and 2.

The proposed amendments would revise the administrative controls section of the technical specifications to change the operator license requirements for operations management.

In its February 22, 1996, submittal, Indiana Michigan Power Company proposed to:

a.

Remove the requirement that the Operations Superintendent must hold or have held a Senior Operator License at Donald C.

Cook Nuclear Plant, or a similar reactor.

b.

Revise the Technical Specification to state that a mid-level operations manager will only be required to hold a Senior Operator License if the Operations Superintendent does not hold one.

On May 1 and June ll, 1996, the staff held discussions with the licensee regarding the proposed amendment.

Consequently, on July 22, 1996, the licensee submitted a revised proposed amendment to Technical Specification Section 6.

The revised submittal was more restrictive than the original submittal and did not change the staff's original no significant hazards consideration determination.

In its July 22, 1996, revised submittal, Indiana Michigan Power Company proposed to:

a 0 Revise the Technical Specification to require that the Operations Superintendent must hold or have held a Senior Operator License at Donald C.

Cook Nuclear Plant, or a similar reactor, or have been certified for equivalent senior operator knowledge.

Revise the Technical Specification to state that if the Operations Superintendent does not hold a Senior Operator License, a line (vice staff) operations middle manager will be required to hold a

Senior Operator License for the purpose of directing operational activities.

2. 0 EVALUATION The staff has evaluated the licensee's request for approval to amend Technical Specification 6.0, "Administrative Controls," for Cook Nuclear Plant Units 1

and 2 using Standard Review Plan (SRP),

13. 1.2 - 13. 1.3, "Operating Organization."

Title 10 of the Code of Federal Re ulations Section 50.54(l) requires the licensee to "designate individuals to be responsible for directing the licensed activities of licensed operators.

These individuals shall be licensed as senior operators;..."

Indiana Michigan Power Company is committed to ANSI N18. 1-1971, "Selection and Training of Nuclear Power Plant personnel,"

which requires the Operations Manager to hold an SRO license at the time of appointment to the active position.

This ensures that the supervisor responsible for directing the licensed activities of licensed operators on shift holds a Senior Reactor Operator (SRO) license.

By stating in the proposed Technical Specification that if the Operations Superintendent does not hold a Senior Operator License, a line (vice staff) operations middle manager will be required to hold a Senior Operator License for the purpose of directing operational activities, the licensee ensures that a licensed off-shift senior operator will direct the licensed activities of the licensed operators.

Requiring the Operations Superintendent or the operation middle manager directing licensed activities to hold a Senior Operator License meets the intent of ANSI N18. 1-1971 and ensures there is site-specific, relevant technical and systems knowledge in an off-shift operations management position.

3.0

SUMMARY

The staff concludes that the proposed amendment to Donald C.

Cook Nuclear Plant, Units 1

and 2 Technical Specification Section 6 meets the relevant criteria in SRP

13. 1.2-13. 1.3, "Operating Organization,"

10 CFR 50.54(l) and ANSI/ANS and is, therefore, acceptable.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Michigan State official was notified of the proposed issuance of the amendments.

The State official had no comments.

5. 0 ENVIRONMENTAL CONSIDERATION The amendments change the requirements with respect to administrative procedures.

The Commission has previously issued a proposed finding that the amendments involve no significant hazards consideration and there has been no

public comment on such finding (61 FR 13527).

Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10).

Pursuant to 10 CFR 51.22(b),

no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

6.0 CONCLUSION

The staff has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed

manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
