NOTICE OF VIOLATION Indiana Hichi'gan Power Company D.

C. Cook Nuclear Plant, Unit 1

Docket No. 50-315 License No.

DPR-58 During an NRC inspection conducted on April ll through 22,

1994, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violation is listed below:

10 CFR 50.59 requires, in part, that changes made to the facility as described in the safety analysis report be evaluated in accordance with 50.59(a) to determine, in part, if an unreviewed safety question exists.

Section 9.5.3 of the D.

C.

Cook Nuclear Plant Updated Safety Analysis Report (USAR) states that the Component Cooling Water (CCW) system component design data are listed in Table 9.5-3.

Table 9.5-3 states that 'the shell side CCW heat exchanger outlet design water temperature is 95'F.

Contrary to the above, the Unit 1

CCW heat exchanger outlet water temperature as described in Table 9.5-3 of the USAR was authorized to be exceeded, and was actually exceeded, on January 27, 1994, without the required evaluation to determine if an unreviewed safety question existed.

Specifically, the Operations Department Superintendent authorized increasing the temperature limit to 105 F at 1915 hours0.0222 days <br />0.532 hours <br />0.00317 weeks <br />7.286575e-4 months <br /> on January 27,

1994, and subsequently the operator increased the temperature above 95'F.

The temperature was allowed to increase

.to 110'F.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Consumers Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control

Desk, Washington, D.C. 20555, with a copy to the U.S. Nuclear Regulatory Commission, Region III, 801 Warrenville Rd., Lisle, Illinois 60532-4351, and a copy to the NRC Resident Inspector at the Big Rock Point Nuclear Plant within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or 'a Demand for Information'may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.
