NOTICE OF VIOLATION Indiana Hichigan Power Company Donald C.
Cook Nuclear Power Plant Docket Nos. 50-315; 50-316 License Nos.
DRP-58; DRP-74 During an NRC inspection conducted on October 20,
- 1993, through December 7,
1993, violations of NRC requirements were identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (1991), the violations are listed below:
A.
Section 4.0.5 of the Unit 2 Technical Specifications (TS) requires that the licensee implement surveillance requirements for inservice inspection and testing of ASHE Code Class 1, 2, and 3 components in accordance with Section XI of the ASHE Boiler and Pressure Vessel Code and the applicable Addenda as required by 10 CFR 50, Section 50.55a(g).
Paragraph (b) of Subsection IWV-3417, which is the Code subsection for inservice testing of valves, requires that for a valve which fails to exhibit the required change of valve stem or disk position or which exceeds its specified limiting time value of full stroke by this
- testing, corrective action shall be initiated immediately. If the condition is not, or cannot be, corrected within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />, the valve shall be declared inoperative.
Contrary to the above, on September 2,
1993, the Unit 2 trip and throttle valve for the turbine-driven auxiliary feedwater pump failed to exhibit the required change of valve position during testing, but the condition was not corrected, nor was the valve declared inoperative within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.
This is a Severity Level IV violation (Supplement 1).
B.
10 CFR 50, Appendix 8, Criterion III, requires, in part, that measures be established for the selection and review for suitability of application of materials,
- parts, equipment, and processes that are essential to the safety-related functions of the structures,
- systems, and components.
Contrary to the above, the licensee's review of Hinor Hodifications 12-HH-253 and 12-HH-254, which were initiated to replace pilot operated valves in the plant's Emergency Diesel Generator (EDG) air start systems with valves from another manufacturer, did not identify that the new valves pere not suitable for that application.
This ultimately resulted in the Unit 2 AB EDG being inoperable for an unknown period of time between December 13,
- 1991, and January 13, 1992.
This is a Severity Level IV violation (Supplement I).

Notice of Viol ati on With respect to Item 8, the inspection showed that actions had been taken to correct the identified violation and to prevent recurrence.
Consequently, no reply to the violation is required and we have no further questions regarding this matter.
With respect to Item A, pursuant to the provisions of 10 CFR 2.201 Donald C.
Cook Nuclear Power Plant is hereby required to submit a
written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington D.C.
20555 with a copy to the U.S.
Nuclear Regulatory Commission, Region III, 801 Warrenville Road, Lisle, Illinois, 60532-4351, and a copy to the NRC Resident Inspector at the Donald C.
Cook Nuclear Power Plant, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
