PROPOSED IMPOSITION OF CIVIL PENALTY 525,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 will be issued on or about August 2, 1993, to Indiana
& Michigan Power Company.
This action is based on a Severity Level III violation, occasioned by a U. S. Department of Labor (DOL)
Administrative Law Judge finding that an employee of American Nuclear Resources, Inc.
(a subcontractor at the D.
C.
Cook facility) had been terminated as the result of engaging in protected activities.
The base Severity Level III civil penalty of $50,000 was mitigated 504 based on the licensee's overall past performance.
This adjustment resulted in a net decrease of
$25,000.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice August 5, 1993 Telephone Notification of Licensee August 5, 1993 The State of Ohio will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
