Dear Mr. Denton:
We enclose herewith a check for $4,400.00 in response to Mr.
W. 0. Miller's letter of April 9, 1980 which requested a processing fee for NRC's review of our AEP:NRC:00213D submittal. of March 24, 1980.
Our submittal requested approval to employ divers to cut studs in the Spent Fuel Pool, which approval was granted on by letter dated March 25, 1980.
- However, we respectfully request you to review and reconsider the question of whether such a fee is necessary in this case.
We believe that such a fee is unwarranted because the technical correctness of the request was obvious.and approval should have been nothing more than pro forma.
The use of divers in this case resulted in an as-low-as-possible exposure to plant and contractor personnel, a goal which should be common to both us and the NRC.
Additionally, the Spent Fuel Pool is common to both Units which eliminates the need for a Class I fee.
Accordingly, we believe the fee should be refunded to us, either in whole or in part.
