Dear Mr. Boger:

The purpose of this letter is to request a one year exemption from 10 CFR 50, Appendix E, Section F.3 for 1992.

FEMA has requested that the State of Michigan and Indiana Michigan Power Company reschedule the off-site participation portion of the radiological emergency preparedness (REP) exercise for the Donald C.

Cook Nuclear Plant by one year (see the attachment to this letter.)

The current exercise schedule requires Michigan to participate in one off-site exercise one year and in three off-site exercises during the next year.

The current schedule places an uneven workload on the FEMA Region V Office in their evaluation of REP exercises.

The affected local jurisdiction, Berrien County, participates in both the Palisades and Donald C.

Cook Nuclear Plant REP exercises.

The schedule change would not reduce the number of exercises in which Berrien County participates.

This proposed schedule change would move State of Michigan and Berrien County participation from the November, 1992 exercise to the May, 1993 exercise.

The November, 1992 exercise would then be a

utility only exercise.

Therefore, in 1992, we will not meet the requirement that "each licensee at each site shall exercise with offsite authorities However, given that the State of Michigan and Berrien County exercise with Palisades and that the exemption is only for one year, we believe that the schedule change is acceptable.

Following 1992, the exercise schedule will continue to meet 10 CFR 50 Appendix E requirements.

Dear Nr. Fitzpatrick:

During 1990, in several meetings with the Federal Emergency Management

Agency, Region V Office, PENA requested that the State of Michigan and the American Electric Power Company reschedule the off-site participation in the Radiological Emergency Preparedness exercise for the Donald C.

Cook Nuclear Power Plant by one year.

The current schedule requires Michigan to participate in one off-site exercise one year, and in three off-site exercises during the next year.

This one/three schedule places an uneven workload on the FENA.Region V Office in their evaluation of the REP exercises.

In discussions with Ms. Leah Bounds, AEP Radiological Emergency Preparedness, and this office, Mr. Bement, Chairman of the FENA Region V RAC; indicated that FEMA Region V's request for such a change in exercise participation would be supported by the National FEMA office.

The State of Michigan and American Electric Power Company discussed the issue and had no objections to the schedule change.

The affected local jurisdiction, Berrien County, participates in both the Donald C.

Cook and Palisades Nuclear Power Plant REP exercises.

The schedule change would not reduce the number of exercises that they participate in, but would only change the schedule.

Ms. Bounds discussed the issue with the NRC Region III Office, which indicated

.support for the change.

This office then provided correspondence to the FEMA Region V Office requesting the change in schedule.

FEMA Region V has now been in contact with us and has stated that FEMA Headquarters supports the change in exercise

schedule, but that any change in off-site participation also needs to be initiated by the American Electric Power Company through the NRC Region III Office.

Once NRC Region III has approved the change and forwarded it to NRC Headquarters, FEMA Headquarters can then approve the rescheduling of the off-site participation in the Donald C.
