Docket No. 50-315 and 50-316 (EA 90-194)
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $ 150,000 This is to inform.the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 150,000 will be issued on or about March 6, 1991 to Indiana Michigan Power Company.
This action is based on inadequate control of plant designs related to post-fire shutdown capabi'lity.'his resulted in a condition whereby a fire in one of two fire areas could have eliminated all power supplies to Unit 1 local shutdown indication panels and control room indications.
No alternative means existed to obtain information related to the lost instrumentation and the likelihood existed that safe shutdown of Unit 1 could not have been achieved and maintained.
The base civil penalty was escalated by 100% for prior notice due to NRC 1988 and 1989 inspection concerns related to design controls applied to Appendix R modifications.
The civil penalty was escalated an additional 100% based on the added significance of the duration of the violation because the facility was operated outside of, regulatory fire protection requirements for four years.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Hailing of Notice March 6, 1991 Telephone Notification of Licensee March 6, 1991 The State of Indiana will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
