DPR-58; DPR-74 As a result of the inspection conducted on August 27 - 31 and September 14,
- 1990, and in accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Part 2, Appendix C (1989)

Policy) the following violation was identified:
10 CFR 20.201(b) requires that each licensee make or cause to be made such surveys as (1) may be necessary for the licensee to comply with the regulations in 10 CFR Part 20 and (2) are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present.
10 CFR 20.201(a) defines a survey as an evaluation of the radiation hazards incident to the production,
- use, release, disposal or presence of radioactive materials or other sources of radiation under a specific set of conditions.
Contrary to the above, on July 11, 1990, a test of the operability of a highly contaminated Chemical Volume and Control System safety relief valve was con'ducted without adequately evaluating the extent of the radiological and physical hazards associated with the new test equipment being used.
The test malfunctioned which resulted in an employee receiving an unnecessary radiation exposure and a minor physical injury.
This is a Severity Level IV violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
( 1) the corrective steps that have been taken and the results achieved; (2) the corrective steps that will be taken to avoid further violations; and (3) th'e date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
