Cook Nuclear Plant NPDES Permit No. MI 0005827 In response to your February 10, 1989 "Notice of Noncompliance and Order to Comply," (Order No. 02-89-08-002P)
Indiana Michigan Power (I&M) has rerouted wastewater flows at Cook Nuclear Plant such that continuous compliance will be assured at Outfall OOF.
The plant has returned the filter backwash flow to the turbine room sump which discharges to groundwater via the absorption pond.
This action is allowed under the groundwater provisions of the current permit.
Since it was the company's original intention to lessen groundwater effluent by discharging the filter backwash to the
- lake, we will be investigating a demonstration to justify alternative permit conditions for Outfall OOF.

Box 60 Fort Wayne, Indiana 46801 ATTENTION: Mr. D.L. Baker PLEASE BE ADVISED THAT we have sufficient information to believe that your facility has failed to comply with the terms and conditions of your National Pollutant Discharge Elimination System (NPDES) Permit issued on September 19, 1985 and modified on April 2, 1987.
PURSUANT to the aforementioned permit (Part I, Section A.4), Any discharge from your facility is limited to the following for outfall OOF (Filter Backwash).

- 1989, a plan showing how the Company will consistently and reliably meet all NPDES permit requi,rements for outfall OOF by May 15, 1989.
Continued failure to comply with the NPDES permit or with this order will result in further administrative actions.
BE ADVISED that compliance with the terms of this Notice of Noncompliance does not constitute a release or waiver of liability for violations, past or continuing, of the NPDES permit or Act 245, P.A. of 1929, as amended.
