This letter provides the required response to the Notice of Violation transmitted to us in Mr. A. B. Davis'etter dated January 4,
1980

Infraction 10 CFR 71.51(a) requires that a licensee "shall establish, maintain and execute a quality assurance program satisfying each of the applicable criteria specified in Appendix E, 'guality Assurance Criteria for Shipping Packages for Radioactive Material'..."
It further requires that "The description of the quality assurance program shall include a discussion of which requirements of Appendix E
are appli'cable and how they will be satisfied,"
and that "A description of that-prograra shall be filed, in accordance with this
- section, by January 1, 1979, with the Director, Office of Nuclear Material Safety and Safeguards, Nuclear Regulatory Commission, Washington, D.C. 20555."
Contrary to the above, no quality assurance program for shipping packages was in effect and no description of such a program had been filed with the Director, NMSS.

Mr. James G. Keppler, Regional Director AEP:NRC:00350 Item 1 - Corrective Actions The quality assurance program requirements of 10CFR71 and Appendix E
thereto will be met by imposing the existing, Commision - approved, 10CFR50 Appendix B plant quality assurance program to radioactive waste packaging and shipping activities at the Donald C.
Cook Nuclear P1ant.
The requirements of the existing plant quality assurance program will be implemented via existing plant procedures; the Plant Process Control Procedure for radioactive waste; and where required, through development of new procedures.
Contractors performing on site radio-active waste packaging and shipping activities will be required to comp'ly with all applicable 10CFR71 Appendix E guality Assurance Program requirements.
Full implementation of this corrective action is targeted to April 30, 1980.
Until full implementation is achieved, the Donald C.Cook Nuclear Plant guality Assurance Department will perform inspections on radio-active waste packaging and shipping activities to assure that the intent of 10CFR71 Appendix E requirements are met.
A description of the quality assurance program as applicable to radioactive waste packaging and shipping will be submitted shortly to the NRC as required by 10CFR71.51. (a).
