Dear Mr. Denton:
This letter is to confirm our telephone conference with your staff on January 29, 1986, concerning the applicability of Technical Specification 3.11.1.4 (Units 1 and
- 2) to the Refueling Water Storage Tanks (RWST).
Technical Specification 3.11.1.4 applies to "outside temporary tanks" and establishes a 10-curie limit on the amount of radioactivity the tanks may contain.
The specification states:
"Tanks included in this specification are those outdoor tanks that are not surrounded by liners, dikes, or walls capable of holding the tank contents and that do not have tank overflows and area drains connected to the liquid radwaste treatment system."
Even though the RWSTs at the D. C. Cook Plant do not have liners, dikes, etc. they are a part of the permanent plant design basis required for both normal and emergency operations and therefore are not considered temporary tanks.
Therefore, as concluded by your staff and ourselves, the RWSTs are not tanks to which Technical Specification 3.11.1.4 applies.
Unless we are informed to the contrary by your staff, we will continue to interpret this Technical Specification in the above manner.
Please note that we intend to request a Technical Specification change to clarify this matter on a more permanent basis.
