C. Cook Nuclear Plant Unit Nos.

1 and 2.

Mr. S.

A. Varga's letter requested that we review the Technical Evaluation Report (TER) prepared by Franklin Research Center (FRC), and provide justification for protection from public disclosure for any proprietary information appearing on those FRC TER pages identified as containing claimed proprietary material.

Our review of the TER has resulted in the identification of thirty-eight (38) pages (in each Unit's TER) which are, stamped "Proprietary Information".

Each of the thirty-eight (38) pages are identical for the D. C.'ook Unit No.

1 TER-C5257-497 and the D.

C.

Cook Unit No.

2 TER-C5257-498.

Attachment 1 to this letter provides a list of the identified pages and the corresponding justification for protection from public disclosure.

Attachment 2 contains copies of the thirty-eight identified pages which, as noted above, are the same for both Units.

We note that the SER requires that any justification for protection from public disclosure be. at a level of specificity consistent with the criteria enumerated in 10 CFR 2.790(b).

RC:0775A information to be withheld from public disclosure on the identified pages has been extracted from Westinghouse Electric Corporation documents and has been enclosed in brackets as shown in Attachment 2.

The identified material corresponds to information which appears in brackets in the referenced Westinghouse documents.

We cannot guarantee, however, that additional information contained in the TER (on both the thirty-eight identified pages and all other pages) can be released to the public record without the objection of Westinghouse Electric Corporation or any other manufacturer or vendor.

Such additional information includes both handwritten and typed comments made by FRC staff, and material extracted from non-bracketed portions of proprietary documents.

For further information on the withholding of bracketed versus non-bracketed material from the identified TER

pages, we suggest that the NRC contact Westinghouse directly.

We also note that any information which is to be withheld from public disclosure in the identified TER pages should be deleted from Attachment 2 before this letter is. released to the public record.

Furthermore, the Westinghouse Applications for Withholding from Public Disclosure were, in most cases, unavailable to us for review.

These documents, if not already present in NRC files, should be obtained directly from Westinghouse by the NRC staff.

This document has been prepared following Corporate Procedures which incorporate a reasonable set of controls to ensure its accuracy and completeness prior to signature by the undersigned.
