Dear Mr. Denton:
On November 15, 1982, Unit No.
3 of the San Onofre Nuclear Generating Station was granted an operating license.
San Onofre Unit No.
3 has become the 80th nuclear reactor to participate in the Industry Retrospective Rating Plan.
Both Units of the Donald C.
Cook Nuclear Plant also participate in this Secondary Financial Protection Plan.
As noted in 10 CFR 140.11(4),
each unit participating in the plan is required to maintain Secondary Financial Protection in the amount of 5 million dollars.
The financial protection provided by ANI/MAELU amounts to 160 million dollars and since the secondary layer of protection afforded by the Secondary Finanancial Protection Plan is 400 million dollars, the total financial protection now available is 560 million dollars.
This amount is in excess of the 500 million dollar statutory limit of liability, as specified by 10 CFR 140.7.
As
- such, the indemnity fee of six dollars per year per thermal capacity is no longer applicable.
The indemnity fee has been reduced to now stand at a flat rate of 1,000 dollars per year per reactor.
Our letter No. AEP:NRC:0688 transmitted a check for 19,500 dollars in payment of the indemnity fee for Donald C. Cook Nuclear Plant Unit No.
1 for the one-year time period from May 26, 1982 through May 25, 1983.
Our letter No. AEP:NRC:0688A transmitted a check for 20,346 dollars in payment of the indemnity fee for Donald C. Cook Nuclear Plant Unit No.
2 for the one-year time period from August 18, 1982 through August 17, 1983.
These two payments reflect the indemnity fee of six dollars per year per megawatt of thermal capacity. It is 8302040286 83020i PDR ADOCK OSO003fS PDR go~
