50-315 50-316 EA 81-55 As a result, of an inspection conducted by an inspector of the NRC Region V

otfice on February 23, 1981, at the U.

S.

Ecology, Incorporated,

Beatty, Nevada, disposal site, and in accordance with the Interim Enforcement Policy, published in the Federal Register 45 FR 66754 (October 7, 1980), the following violations were identified.

A.

10 CFR 71. 5 prohibits transport of any licensed material outside the confines of the plant or other place of use or delivery of licensed materials to a carrier for transport unless the licensee complies with applicable regulations of the Department ot Transportation in 49 CFR Parts 170-189.

49 CFR 173.392(c)(1) requires that packaged shipments of low specific activity (LSA) materials transported in exclusive use vehicles must be packaged in strong, tight packages so. that there will be no leakage of radioactive material under conditions normally incident to transportation.

Contrary to the above, radioactive material contained in Tank No.

4 leaked from an LSA shipment on Trailer No. 440043 from the D.

C.

Beatty, Nevada, disposal site.

Specifically, upon inspection of the shipment at the disposal site on February 23, 1981, a white powdery residue that leaked from around the bung was observed around the bung on Tank No. 4, on the trailer surface beneath the tank and on the immediate surrounding surfaces.

The presence of radioactive material on and around the tank was confirmed by contamination surveys.

This is a Severity Level III violation (Supplement V.)

B.

10 CFR 30.41(a) requires that no licensee shall transfer byproduct material except as authorized pursuant to Section 30.41 of Part 30.

Section 9B of License No. 13-11-0043-02 issued by the State of Nevada to U.

S.

Ecology, Incorporated requires that all liquid radioactive waste shall be solidified.

Contrary to the above, Tank No.

4 of an LSA shipment from the D.

C.

Cook Nuclear Power Plant to the U.

S.

Ecology, Incorporated,

Beatty, Nevada, disposal site was found to contain liquid when the tank was drained at the disposal site on February 24, 1981.

Section 9B of the State of Nevada License No.

1311004302 states that all liquid radioactive waste shall be solidified prior to burial.

Further, a May 17, 1978 letter from the State of Nevada to Nuclear Engineering

This letter stated, in part, "Beginning May 19, 1978, only radioactive liquid waste material in scintillation vials...

This is a Severity Level III violation (Supplement V.)

Pursuant to the provisions of 10 CFR 2.201, American Electric Power Service Corporation is hereby required to submit to this office within thi'rty days of the date of this Notice, a written statement or explanation in reply, including for each violation:

(1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further noncompliance; and (5) -the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.

Under the authority of Section 182 of the Atomic Energy Act of

1954, as
amended, this response shall be submitted under oath or affirmation.
