REQUEST FOR WITHHOLDINGINFORMATIONFROM PUBLIC DISCLOSURE

Dear Mr. Curet:

By letter dated May 25, 1999, Washington Public Power Supply System (Supply System) submitted additional information on minimum critical power ratio (MCPR) safety limits for Washington Nuclear Project 2 (WNP-2) Cycle 15 operation in response to a written request from the NRC staff and to discussions with the NRC staff.and requested that the information be withheld from public disclosure pursuant to 10 CFR 2.790.

An affidavit dated April27, 1999, from Siemens Power Corporation (SPC) the owner of the information, was included in the application.

SPC states that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

The Document contains information of a proprietary and confidential nat'ure and is of the type customarily held in confidence by SPC and not made available to the public. Based on my experience, I am aware that other companies regard information of the kind contained in the Document as proprietary and confidential.

The Document has been made available to the U.S. Nuclear Regulatory Commission in confidence, with the request that the information contained in the Document will not be disclosed or divulged.

6.

The Document contains information which is vital to a competitive advantage of SPC and would be helpful to competitors of SPC linen

. competing with SPC.

7.

The information contained in the Document is considered to be proprietary by SPC because it reveals certain distinguishing aspects of SPC licensing methodology which secure competitive advantage to

'PC for fuel design optimization and marketability, and includes information utilized by SPC in its business which affords SPC an opportunity to obtain a competitive advantage over its competitors who do not or may not know or use the information contained in the Document.

The disclosure of the proprietary information contained in the Document to a competitor would permit the competitor to reduce its expenditure of money and manpower and to improve its competitive position by giving it valuable insights into SPC licensing methodology and would result in substantial harm to the competitive position of SPC.

The Document contains proprietary information which is held in confidence by SPC and is not available in public sources.

In accordance with SPC's policies governing the protection and control of information, proprietary information contained in the Document has been made available, on a limited basis, to others outside SPC only as required and under suitable agreement providing for nondisclosure and limited use of the information.

11. SPC policy requires that proprietary information be kept in a secured file or area and distributed on a need-to-know basis.

Information in this Document provides insight into SPC licensing methodology developed by SPC.

SPC has invested significant resources in developing the methodology as well as the strategy for this application. Assuming a competitor had available the same background data and incentives as SPC, the competitor might, at a minimum, develop the information for the same expenditure of manpower and money as SPC."

We have reviewed your submittal and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of SPC's statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information and should be withheld from public disclosure..

Therefore, the letter dated July 8, 1988, KVW:98:148 from K. V. WaIters to R. A. Vopalensky, titled, "MCPR Safety LimitReanalysis for WNP-2 Cycle 11," marked as proorietary, willbe withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, ifany, of persons properly and directly concerned to inspect the complete documents.

Ifthe need arises, we may send copies of this information to our consultants working in this area.

We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

Ifthe basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, for example, ifthe scope of a Freedom of Information Act
