NRC INSPECTION REPORT 50-397/95-15 AND NOTICE OF'VIOLATION Thank you for your letter of August 1,
- 1995,
.in response to our letter and Notice of Violation dated July 5, 1995.
Violation 397/9515-01 pertained to a
fire watch not being present during work involving ignition sources on May 24, 1995.
In your reply, you denied that a violation occurred.
Your positio'n was based on your contention that the fire watch involved could have promptly detected and responded to the signs of an incipient fire when he was some distance away from the work area, in an adjoining area of the room at a telephone.
You also contend that the fire watch was only absent for a short period (approximately 2 minutes).
Our interpretation of your fire protection program and the National Fire Protection Association (NFPA) code applicable to these circumstances leads us to conclude that leaving the immediate area represented an inadequate fire watch in that it did not fulfill the requirement for continuous coverage.
We note that your fire protection program specified in Plant Procedures Manual 1.3. 10, "Fire Protection Program Implementation," states that during spark producing operations a "fire watch remains at the job site for 1/2 hour after the work is done."
As our inspection report describes, after observing the grinding operations with combustible polyethylene bags
- nearby, the NRC inspectors returned to the work area and did not find a fire watch posted in the area.
In as much as the NRC inspectors standing at the location where the grinding occurred could not see the firewatch in the adjoining area of the
- room, we do not accept your assertion that he met the intent for a continuous fire watch.
We also note that the fire extinguisher for the fire watch's use was located very close to the work area.
The fire watch may not have been able to get to the fire extinguisher in response to a fast developing fire had
,one occurred.
Therefore, we conclude that the requirement for a continuous fire watch in the immediate area of the work for a period of 1/2 hour was not met.
Our view is that the conditions cited in the original Notice of Violation involved important equipment (control rod drive system
- pumps, associated
- valves, and piping) with combustible material in the area of the grinding work.
- However, in view of the additional information you provided on the location and duration of absence of the fire watch, we now consider this to be a violation of minor significance.
As such, it will be treated as a noncited violation, consistent with Section IV of the NRC Enforcement Policy.
