INVESTIGATION CASE NO. 4-94-046 (WNP-2)
Dear Mr. Parrish:
This is in reference to an investigation conducted by the NRC's Office of Investigations (OI) regarding an October 18, 1994, incident involving a fire tour watch at Washington Nuclear Project, Unit 2 (WNP-2).
On that date, a
WNP-2 health physics technician observed an individual who was performing fire watch duties twice bypass a portal monitor and fail to monitor himself for contamination before entering the Control Room.
WNP-2 personnel promptly brought this to the attention of plant management and informed the NRC Resident Inspector.
As Washington Public Power Supply System reported in a November 30,
- 1994, letter to the NRC, its own investigation of this matter found that the individual willfullyviolated health physics procedures.
Your letter stated that a decision was made to terminate the individual's employment for neglect of duty.
OI reviewed the results of your investigation and confirmed that the individual had deliberately bypassed the portal monitor.
Our review of the information related to this investigation determined that this individual deliberately violated WNP-2 procedure l. 11. I, entitled "Entry Into, Conduct In, and Exit from Radiologically Controlled Areas."
This procedure requires personnel entering "clean areas" within the radiologically controlled area to perform personnel contamination monitoring in accordance with the procedure.
In accordance with Section VII.B.2 of the NRC's Enforcement Policy, the NRC has decided that a Notice of Violation will not be issued because this violation was identified by WNP-2 personnel, the NRC was promptly informed, the violation involved the acts of a low-level individual who was acting on his own, and significant remedial action was taken such that it demonstrated the seriousness of deliberate violations to other plant personnel.
