DENIAL OF AMENDMENT TO OPERATING LICENSE FOR EXCLUSION OF A HIGH-ENERGY LINE BREAK IN THE REACTOR WATER CLEANUP SYSTEM FOR WNP-2 (TAC'NO. H88370)
In your letter dated December 3,
- 1993, you requested an amendment to Operating License No. NPF-21 for an unreviewed safety question regarding a high-energy line break in the reactor water cleanup (RWCU) system.
After careful review, the NRC staff has concluded that your request cannot be approved.
The basis for this finding is documented in the enclosed Safety Evaluation.
The NRC staff has considered the information in your amendment request in assessing the acceptability of continued operation.
The staff finds that the current piping condition and low stress levels provide sufficient justification for interim operation for one refueling cycle.
The Washington Public Power Supply System needs to complete the necessary analyses and design reviews and plant modifications to address the required postulated pipe break in the RWCU system prior to restart from the 1995 refueling outage.
Any future requests for amendments to the operating license submitted pursuant to 10 CFR 50.59 should include your basis for determining that an unreviewed safety question exists.
This will allow the NRC staff to assess the appropriateness of your determination that a license amendment is necessary.
You are also requested to provide the basis for conclusions stated in your submittals, for example, the conclusion in your December 3,
1993, letter that compliance with Branch Technical Position (BTP)
HEB 3-1 would result in hardship without a compensating increase in the level of quality and safety.
Although this conclusion did not form part of the basis for denial of the amendment
- request, the basis for this conclusion would have been necessary to process the amendment if the staff had accepted your interpretation of the BTP.
The staff noted that you requested the amendment pursuant to 10 CFR 50.91 and CFR 50.55a(a)(3).
The correct reference for amendments to a license is 10 CFR 50.90.
This is also the reference for changes made pursuant to 10 CFR 50.59 that involve unreviewed safety questions as did this amendment request.
The staff also notes that you referenced 50.55a(a)(3),
which implies a request for relieI from the applicable code.
