PROPOSED IMPOSITION OF CIVIL PENALTY $5,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $5,000 will be issued on or about March 3, 1993 to Washington Public Power Supply (WNP-2).
This action is based on the licensee's failure to ensure that licensed material transported outside the confines of its plant met the DOT regulations in 49 CFR Parts 170 through 189.
Specifically, the radiation level at the surface of the package was 260 mR/hr which exceeded the 200 mR/hr limit It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice March 3, 1993 Telephone Notification of Licensee March 3, 1993 The State of Washington will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
