PROPOSED IMPOSITION OF CIVIL PENALTY $ 75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $75,000 will be issued on or about December 14, 1992, to the Washington Public Power Supply System.
This action is based on three violations identified during the review of the August 15,
- 1992, reactor power oscillation event which resulted in the manual scram of the reactor.
These violations have collectively been classified as a Severity Level III problem.
The base civil penalty of $50,000 has been escalated 50 percent after finding 50 percent escalation appropriate for both past poor performance and prior opportunity to identify the problems and 50 percent mitigation for the licensee's corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Washington will be notified.
December 14, 1992 December 14, 1992 The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
