"Emergency Change to Technical Specification Surveillance Requirement 4.8. 1. 1.2.d.2 for Facility Operating License NPF-21 (TAC No. 75564)", dated January 5, 1990 In Reference 1 the Supply System requested that the WNP-2 Tech. Spec. be amended on an emergency basis to eliminate the subject surveillance requirement and to add a new diesel fuel oil surveillance (ASTH-D2276-78, Method A) in order to ensure that diesel generator operability not be impaired by insoluables in the fuel oil. In Reference 2 the NRC concluded that sufficient information had been submitted to allow them to temporarily waive compliance with Surveillance Requirement 4.8. 1. 1.2.d.2 effective immediately, and to remain effective until completion of their review of the Supply System's January 4, 1990 amendment request.

After considerable discussion with the Staff, the Supply System agrees to modify their amendment request as follows:

1) On page 3/4 8-4, do not delete 4.8. 1.1.2.d.2 as submitted.

Instead, an asterisk will be added at the end of item 4.8. 1. 1.2.d.2 P'DC

2) Also on page 3/4 8-4, instead of adding a new insert (paragraph e), the same insert will be slightly modified to be in effect only until May 30, 1990, and annotated with an asterisk to be in effect during that period in lieu of item 4.8. 1. 1.2.d.2.

A modified page 3/4 8-4 is included to reflect the above changes. As this modification does not change the type of test requested or reduce the frequency originally contemplated, the Supply System has determined that the arguments put forth in Reference 1 with respect to this not being an unreviewed safety question nor constituting a significant hazards consideration are still valid.

It is the Supply System's understanding that this change is being approved on a temporary basis with the expectation that our examination of the diesel fuel oil program will lead to broader changes being requested in the form of a subsequent amendment request. As discussed, we expect to be able to submit such a request to the NRC by March 30, 1990. This will require the Staff to expedite their review in order to minimize the impact of the expiration date of May 30, 1990.
