PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about January 24, 1990 to Mashington Public Power Supply System.
This action is based on violations of the equipment qualification requirements of 10 CFR 50.49.
In accordance with the "Modified Enforcement Policy Relating to 10 CFR 50.49," (Modified Policy) contained in Generic Letter 88-07, the violations have been categorized as a Category B Violation.
The mitigation and escalation factors of the Modified Policy were considered and full mitigation of the civil penalty resulted.
However, under the Modified Policy normally only Category C violations will be issued without a civil penalty and therefore a civil penalty of $50,000, the minimum penalty for a Category B
violation, is proposed in this case.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice January 24, 1990 Telephone Notification of Licensee January 24, 1990 The State of Mashington will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
