NRC INSPECTION REPORT NO. 50-397/99-09

Dear Mr. Parrish:

This refers to the inspection conducted on July 25 through September 4, 1999, at the WNP-2

facility. The enclosed report presents the results of this inspection.

During the inspection period, your conduct of activities was generally characterized by

safety-conscious

operations, sound engineering and maintenance practices, and careful

radiological work controls.

Based on the results of this inspection, the NRC has determined that three Severity Level IV

violations of NRC requirements occurred.

Some of the violations were comprised of multiple

examples.

These violations are being treated as noncited violations, consistent with

Appendix C of the Enforcement Policy. The noncited violations are described in the subject

inspection report.

With respect to the 10 CFR Part 50, Appendix B, Criterion III (Design Control) violation, we

have documented three design-related problems concerning the accuracy and fidelityof your

Technical Specifications.

We have also noted during the past 18 months that four similar

issues were previously documented

in NRC Inspection Reports 50-397/99-07 and -98-15.

In

all, we have noted seven instances where your Technical Specifications, Bases, or

implementing procedures were inappropriate to the circumstances.

Considering the relatively

small focus that we put into these activities, we are concerned because

the overall fidelityof

your Technical Specifications appears suspect.

You have acknowledged this potential trend

and plan to address it further through your corrective actions program. We willassess

the

results of your review during a future inspection.

If you contest the violations or severity level of the noncited violations, you should provide a

response within 30 days of the date of this inspection report, with the basis for your denial, to

, the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-

0001, with copies to the Regional Administrator, U.S. Nuclear Regulatory Commission,

Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011; the Director, Office of

Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001;

and the NRC Resident Inspector at the WNP-2 facility.
