SUBJECT: NRC AITFOLLOWUP INSPECTION REPORT 50-397/98-20 AND NOTICE OF

VIOLATION

Dear Mr. Parrish:

From August 24 through September

17, 1998, a followup inspection was conducted at your

Washington Nuclear Project-2 reactor facilityto review the facts surrounding the June 17 fire

protection system rupture and internal flooding event.

The enclosed report presents the. scope

and results of that inspection.

In summary, we found that your staff, as an organization, responded well to the challenges of

the event demonstrating effective teamwork with a focus on safety.

Notwithstanding those

successes,

the event itself represented

a culmination of several organizational performance

issues.

These included:

(1) weak implementation of the corrective action process for the fire

protection program, (2) a maintenance program for the floor drain system that did not reflect the

importance of its design function, and (3) a lack of sensitivity for the impact of hot work on the

fire protection system.

Three violations of NRC requirements were identified. The first violation

involved the failure to include the reactor building floor drain cross-connect valves within your

maintenance monitoring program (EA 98-452). The second violation resulted from the failure to

take prompt corrective actions for identified inadequacies

in the controls for hot work. The third

violation related to inadequate compensatory measures for a fire protection system impairment.

The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding these violations are described in detail in the enclosed report.

Please note that you

are required to respond to this letter and should followthe instructions specified in the enclosed

Notice when preparing your response.

The NRC will use your re.ponse,

in part, to determine

whether further enforcement action is necessary to ensure compliance with regulatory

requirements.

In addition, one apparent violation (EA 98-480) was identified and is being considered for

escalated enforcement in accordance with the "General Statement of Policy and Procedure for

NRC Enforcement Actions" (Enforcement Policy), NUREG-1600, Revision 1. The violation

involved the inadequate design of the fire protection water supply system such that the system

can generate destructive forces upon response to a fire detection signal. The failure of the fire

protection water supply system pressure boundary and the resultant inability of the system to

suppress a potential fire was inconsistent with the requirements of 10 CFR Part 50, Appendix A,

General Design Criterion 3, "Fire Protection."

The circumstances surrounding this apparent

violation, the significance of the issue, and the need for lasting and effective corrective actions

were discussed with members of your staff at public meetings in the NRC Region IV offices on

July 2 and at your WNP-2 facilityon July 8. The regulatory characterization of the issue was

further discussed during the inspection exit meeting on September

17. As a result, it may not

be necessary to conduct a predecisional enforcement conference

in order to enable the NRC to

make an enforcement decision.

Before the NRC makes its enforcement decision, we are providing you an opportunity to either

(1) respond to the apparent violation addressed

in this inspection report within 30 days of the

date of this letter or (2) request a predecisional enforcement conference.

If a conference is

held, it willbe open for public observation.

The NRC willalso issue a press release to

announce the conference.

Please contact Greg Pick at (817) 860-8270 within 7 days of the

date of this letter to notify the NRC of your intended response.

lf you elect to respond to the apparent violation, your response should be clearly marked as a

"Response to An Apparent Violation in Inspection Report No. 50-397/98-20" and should include:

(1) the reason for the apparent violation, or, if contested, the basis for disputing the apparent

violation, (2) the corrective steps that have been taken and the results achieved, (3) the

corrective steps that willbe taken to avoid further violations, and (4) the date when full

compliance willbe achieved.

Your response should be submitted under oath or affirmation and

may reference or include previous docketed correspondence,'if

the correspondence

adequately

addresses

the required response.

Ifan adequate response

is not received within the time

specified or an extension of time has not been granted by the NRC, the NRC willproceed with

its enforcement decision or schedule a predecisional enforcement conference.

In addition, please be advised that the characterization of the apparent violation described in

the enclosed inspection report may change as a result of further NRC review. You will be

advised by separate correspondence

of the results of our deliberations on this matter.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its

enclosure(s), and your response (if you choose to provide one) willbe placed in the NRC Public

Document Room (PDR). To the extent possible, your response should not include any personal

privacy, proprietary, or safeguards

information so that it can be placed in the PDR without

redaction.
