Letter GO2-98-128, dated July 17, 1998, JV Parrish (SS) to NRC, "Exigent Technical Specification Amendment Request To Technical Specification Surveillance Requirement 3.8.4.7" The Supply System hereby requests the withdrawal of the exigent Technical Specification amendment request to Technical Specification Surveillance Requirement 3.8.4.7 (Reference 3).

In that correspondence, the Supply System specifically requested modification of Technical Specification SR 3.8.4.7 to allow the performance discharge test to be performed in lieu of the battery service test for Division 2, 125 VDC, Battery E-B1-2.

The Supply System determined that the verbatim requirements of SR 3.8.4.7 had not been fulfilled within the Frequency plus allowed extension time specified in the Technical Specifications.

From the time of the request for the exigent Technical Specification amendment (July 17, 1998) through August 11, 1998, WNP-2 was using the enforcement*discretion granted in Reference 2 to operate while in noncompliance with TS LCO 3.8.4.

That enforcement discretion was to remain in effect until such time that an exigent Technical Specification amendment was issued which would credit the April 1997 performance discharge test required by SR 3.8.4.8 in lieu of the service test in SR 3.8.4.7 for the Division 2 battery, E-B1-2, until the plant entered Mode 4 for the R-14 maintenance and refueling outage (scheduled for mid-1999), or during an outage of sufficient duration, which ever occurred first.

At such time, the Supply System would perform the service test (SR 3.8.4.7) for the E-B1-2 battery.

1998, WNP-2 entered Mode 4

as required by an unrelated Technical Specification required action.

The duration of this forced outage was estimated to be sufficient to perform TS SR 3.8.4.7 and return the E-B1-2 battery to a fully charged and Operable status.

The subject surveillance requirement was satisfied on August 11, 1998 when the battery service test was successfully completed.

As Technical Specification compliance to SR 3.8.4.7 has been reestablished, the need for further exercising of enforcement discretion and issuance of the requested exigent Technical Specification amendment has been removed.

It is the Supply System's understanding that the staff was nearing completion of its approval process for the subject amendment to the WNP-2 Technical Specifications and apologizes for any inconvenience this request may have caused.
