Dear Mr. Auluck:

This letter is in response to a phone conversation with Ray Fish, NRC RV, pursuant to the conversation you had with him concerning my March 7, 1983 letter to you.

As I under stand it, you desire some additional information in order to complete your file on the subject of the Yakima Indian Nation (reference SER, page B10).

Enclosed is a letter from the Supply System dated May 5, 1983, which contains copies of all relevant correspondence concerning meetings and attempts to meet with the Yakima Indian Nation.

As a review of this correspondence indicates, it is my opinion that the Supply System unsuccessfully attempted to meet with the Indian Nation to discuss their concerns.

In the event of an incident with potential offsite consequences, the State procedures call for them to notify contiguous counties (counties included in the ingestion emergency planning zone).

The State utilizes the Law Enforcement Teletype System (LETS) to perform this notification.

Yakima County would receive initial notification via LETS.

The county would, in turn, notify the Tribal Police of the Yakima Indian Nation.

This process should ensure prompt notification of the concerned parties.

Hopefully, this letter answers your primary concerns.

Your letter of July 13, 1982, to which this letter is a response, states that the Yakima Indian Nation "Commented" on the WPPSS II EIS.

This misrepresen-tation of the truth is a, continuation of the pattern of events to date summarized in number 1 above.

For the Yakima Indian Nation to address the significant adverse impacts of NPPSS I, the NRC and NPPSS must first go back and truthfully address the still unresolved issues regarding O'PPSS II and the Yakima Indian Nla ti0 n..

On Thursday, January 21, 1982, Vince Everett and I met with Mr.

Gary Young and Mr. Phil LaCourse of the Yakima Indian Nation.

As you are aware, the meeting had been arranged with Mr. Russel Jim as the representative of the Tribal Council; however, Mr. Jim was attending a funeral on Thursday afternoon and asked Messrs.

Young and LaCourse to meet with us in his stead.

The meeting took place in Mr. Young's office in the Yakima Indian Cultural Center near Toppenish.

A letter from the Yakima Tribal Council to the HRC relative to the.

WNP-2 Draft Environmental Statement (DES) triggered the need for a meeting; however, very little time was spent in discussing specific

'coments on the DES.

Mr. Young and Mr. LaCourse were primarily interested in basic information about the Supply System, our relationship with the State of Washington, the HRC and the NRC licensing process.

They also had some questions relative to our role in emergency planning.

We discussed the relationship of the DES to the WHP-2 ER which was submi tted to the NRC by the Supply System and the process of producing a Final Environmental Statement from the DES, plus public and agency comients.

Mr. Young noted that they had some detailed comments on the DES which they were preparing to send to the HRC.

I noted that the letter would probably be too late to be factored into the FES as I

understood that the FES was either in printing or about to go to press a

that time.

They provided us with' very brief history of the Yakima Nation, pointing out their sovereign nature.

They expressed concern over the fact that the DES did not contain any reference to their existence.

I noted that this was due largely to the fact that our ER did not address their existence and suggested that we need to continue the dialogue to assure that their concerns are addressed in other documents.

They were further annoyed over the fact that their September letter to the NRC had not been responded to.

The meeting was very cordial and we parted with the understanding that additional meetings would be advantageous.

An offer to tour the plants at Hanford was extended.
