SUBJECT:
NOTIFICATION OF ENFORCEHENT DISCRETION During a telephone conference on August 30, 1994 you requested that the NRC exercise its discretion to not enforce compliance with Technical Specification limiting condition for operation (LCO) 3.4.2. 1.a, in order to ensure that you would have sufficient time to repair and test the "B" motor-driven auxiliary feedwater (AFW) pump.
At the time of the request this LCO, which allowed one motor driven AFW pump to be out of service for 7 days or the plant be shutdown in the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />, expired on August 31, 1994 at 5:30 a.m.
We exercised enforcement discretion from 5:30 a.m.
August 31, 1994 until 8:00 a.m.
on September 2,
- 1994, based on the justification provided during that conference which included:

One motor-driven 100X capacity AFW pump, one turbine-driven 200X capacity AFW pump, and 2 standby (manually-started) 100X capacity motor-driven AFW pumps remained available.

Procedures are in place and operators are sufficiently trained to cope with the spectrum of accidents which could occur with the plant in this condition.
~
You agreed to not jeopardize the operability of the remaining operable AFW and standby AFW pumps by performing any testing or maintenance during the period of the enforcement discretion.

Extending the outage time for the "B" motor-driven AFW pump by approximately two days does not significantly increase the probability of any previously evaluated accidents and does not create the possibility of any new or unanalyzed accidents.
~
Requiring a shutdown upon expiration of the LCO would place the plant in a condition in which it would have to rely on the AFW system with its reduced redundancy.
~
No significant safety hazard was involved in extending the outage for the pump by two days.
~
There was no environmental impact associated with this request.

Your P'tant Operations Review Committee had reviewed and approved the request.

l994 Your verbal request for enforcement discretion was followed-up by your letter dated August 30, 1994, in which you provided the details required by NRC Manual Chapter 9900 and documented the discussions of our conference call.
- However, on August 31, 1994 we were informed that the "B" motor-driven AFW pump was returned to service within the time limit of Technical Specification 3.4.2. l.a, at 5:08 a.m.
on August 31,
- 1994, and that the granted enforcement discretion was not used.
