SUBJECT:
NOTICE OF ENFORCEMENT DISCRETION FOR ROCHESTER GAS AND ELECTRIC CORPORATION REGARDING GINNA STATION By letter dated February 15, 1994, you requested the U. S. Nuclear Regulatory Commission (NRC) to exercise its discretion not to enforce compliance with the required actions in Technical Specification (TS) Table 4.1.2, No. 9 for testing the manual containment isolation pushbuttons.
You informed the NRC on February 14, 1994 at 2:00 p.m. that you had determined that the two control room pushbuttons which can be used by operators to manually actuate the containment isolation system, had not been tested as part of the routine surveillance testing of that system.
You also stated that the Ginna Station could not comply with this requirement at power without potentially challenging engineering safety features and safe power operation.
You therefore requested enforcement discretion from 10:00 a.m. on February 16, 1994 until 12:00 a.m. on March 7, 1994, at which time the Ginna Station is expected to achieve cold-shutdown for the 1994 refueling outage.
You provided as basis for continued operation that:
manual containment isolation is only a backup that would be needed iftwo independent automatic safety injection (SI) channels failed one of the two manual pushbuttons had been verified to be operable during the 1993 refueling outage all automatic containment isolation valves had been verified to be operable by stroke testing, and therefore there was high confidence that operators could remotely close all affected containment isolation valves from the control room ifrequired based on the simple mechanical design of the pushbutton, there is a reasonable degree of confidence that the pushbutton will operate ifrequired.

On the basis of our review of your justification, the staff has concluded that postponement of performing this test until after the plant is in cold shutdown beginning March 7, 1994, involves littleor no safety impact, and we are clearly satisfied that this exercise ofdiscretion is warranted from a public health and safety perspective.
The'refore, we will exercise our discretion not to enforce compliance with the requirements ofTS Table 4.1.2 No. 9 from 10:00 a.m. on February.
6, 1994 (the time that the limiting condition for operation for this requirement expires) and 12:00 a.m. on March 7, 1994, when the plant will be placed in cold shutdown and this requirement is no longer applicable.
However, we will consider enforcement
- action, as appropriate for conditions that led to the need for this exercise of enforcement discretion.
