REPLY TO A NOTICE OF VIOLATION Inspection Report 50-244/93-15 Rochester Gas and Electric Corporation R.

DPR-18 During an NRC inspection conducted July 19-23,

1993, a

violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR 2, Appendix C, the violation is listed below:

The R. E. Ginna Nuclear Power Station Physical Security Plan, dated May 1,

1991, Revision A, Section 5.6.1, "Material and Package Search,"
states, in part, that most material and packages for delivery into the PA are brought to the off-loading portal.

After being properly identified and authorization determined, the material and packages are appropriately searched for devices such as

firearms, explosives and incendiary devices, consistent with radiation and practical considerations with five identified exceptions.

Contrary to the

above, on July 22,
1993, the inspectors determined by observation
that, packages, which were not
excepted, were not being appropriately searched by the security officer at the off-loading dock, prior to granting the packages into the protected area.

The security officer opened approximately twenty packages but failed to search the contents.

This is a Severity Level IU Violation (Supplement III).

We agree with this violation on the basis that on July 22, 1993, the security officer assigned to search packages at. the off-loading portal opened approximately twenty packages and performed only a cursory inspection of the contents rather than performing a thorough search as required.

The violation was brought about as a result of confusion on the part of this security officer insofar as what constituted an appropriate search of the specific materials at hand.

The Security Training Supervisor implemented immediate corrective action by relieving the security officer of his duties and having the improperly searched packages searched by another security officer. The security officer involved was provided with hands-on retraining in package searching procedures.

Additional corrective steps taken to avoid future violations of the package search requirements are's follows:

(1)

A review of training methods and perfoxmance certification components was conducted by supervisory training pexsonnel.

Some minor revisions were made to clarify the search requirements.

(2) All security personnel then received refresher training on package searches.

(3)

A Security Supervisor was assigned to observe all package deliveries at the off-loading portal for a period of thirty days to ensure that security personnel were performing package searches in accordance with procedures and instructions received in refresher training.

Full compliance with the NRC-approved R.E.

Ginna Physical Security Plan was achieved immediately upon implementation of the corrective actions initiated by the Security Training Supervisor at the time of the violation.
