Edward C. Shomaker, Attorney Operations and Administration Division Office of the Executive Legal Director RE(UEST FOR WITHHOLDING FROM PUBLIC DISCLOSURE Reference is made to your recent draft letter to Rochester Gas and Electric Corporation with the same subject line.
Our office concurs in the letter with the exception that the fourth and fifth paragraphs of the first page should be deleted and the following substituted:
We have determined that the BEW Report entitled "Strength Testing of Sealable Sleeves Explosively Expanded into Locked Tubes - RGSE Ginna Station", Revision 0, June 7, 1983, marked as proprietary, should be withheld from public disclosure pursuant to 10 C.F.R. 2.790(b)(5) and Section 103(b) of'he Atomic Energy Act of 1954, as amended.
We realize that those paragraphs came out of a current NRC procedures manual, but we are in the process of changing those procedures.
Your letter has the distinction of being among the first changes.
