Dear Sir:

I am writing this letter, under advice of legal consel, in remrds to the recent Rea'ion 1 (USNRC) audit of the R. E. Ginna trainina demrtment. During this audit I was a particimnt in both an oral and written examination.

I understand that this audit was conducted under the guise of NuReg 1021, Section ES-601 (9/1/Bg). i'ontention is that this NuRea does not hav~ the force and effect of Law, therefore I feel that having to take the, exam was pure harrassment.

Furthermore, I feel that I was intimidated bv the NRC into takinz the exam and did so only under duress.

Although I was informed bv the examiner that the proceedinzs were in no wav a reflection upon my license, I realize that if I should. fail the exam, the NRC is bound bv their mandate to take some tvpe of action. A failure to do so would mean that the NRC is failing to carrv out those duties relaczated to them by Con-gress. As such, my livelihood. is placed in'jeopardy by the unlawful actions of your examiners.

I further contend that this examination of me as a license holder is unconsti-tutional under the Fourth Ammendment, "Unlawful Search and Seizure".

At this time I am also requesting that I receive a copy of the written exam-ination which I took on 27 January 1984, alone with anv other documents bearing mv name which were used durinz the auditinz process. I believe that I have this right under the:Freedom of Information Act and/or the Privacy Act.

I also reserve, despite. the outcome of mv written results, the riaht to pursue this matter in any legal avenue that miaht be available to me in the future.

Finally, the thous ts, feelincrs.and. opinions expressed in t~is letter are mv o'vn, and dn not in any way represent the thoughts, feelings and opinions of the Rochester Gas and Zlectric Company.
