Dear Ms. Silva:

On behalf of the nuclear energy industry, the Nuclear Energy Institute (NEI)1 is transmitting to the U.S.

Nuclear Regulatory Commission (NRC) an updated revision to NEI 12-04, Guidelines for 10 CFR 72.48 Implementation. This revision addresses the 11 fundamental issues identified during a series of public meetings conducted between NRC and NEI in 2016 and 2017 (reference [1 through 4]).

We recommend that the NRC endorse the revised NEI 12-04 through a revision to Regulatory Guide 3.72.

Upon endorsement by the NRC, NEI 12-04 would replace NEI 96-07, Appendix B. We would then remove Appendix B from NEI 96-07; however, no changes to the guidance in NEI 96-07 or its other appendices pertaining to 10 CFR 50.59 would be necessary. Until NEI 12-04 is endorsed by the NRC, NEI 96-07 Appendix B continues to remain an acceptable approach to meet 10 CFR 72.48.

The industry believes that this revision is reflective of the progress made to achieve alignment on a common understanding of the 72.48 process over the past five years. Therefore, industry is requesting a meeting with NRC to discuss detailed wording, reflecting this alignment, and finalize the text contained in NEI 12-04 to support the endorsement process. To support the completion of this document, we request NRC comments and/or markup of the enclosed document no later than October 20, 2017 so that this meeting can be held during the week of November 6, 2017. The details of the schedule have been discussed previously with Mr. Raynard Wharton of the NRC.
