This meeting was held at the request of Hecla Limited to discuss with the U.S. Nuclear Regulatory Commission (NRC) staff the status of its Durita closure report and the potential for license termination.

BACKGROUND:

The Hecla Durita site is licensed by the State of Colorado. It was initially licensed in the late 1970s and operated from 1978 through about 1980. The site was dormant until the 1990s when a closure plan was developed and implemented. The State of Colorado approved the discontinuance of the groundwater detection monitoring program upon the completion of the surface and cover reclamation since no groundwater contamination had been detected during the 20 years of detection monitoring. When Hecla requested license termination and the State of Colorado submitted the Completion Review Report (CRR) for NRC review, the issue of termination of the detection monitoring program prior to the request for license termination was brought to light. All issues on the CRR have been resolved except for the groundwater monitoring issue.

DISCUSSION:

To update everyone, the staff stated that its last actions were a site visit and a report regarding the geologic and hydrogeologic nature of the site and preparing an assessment to determine if there is a health and safety issue with the early termination of the groundwater detection monitoring program (the Colorado definition of end of closure is different from the NRC definition). As stated above, the State of Colorado allowed Hecla to plug and abandon the site detection monitoring wells after remedial surface actions were completed; however, the State of Colorado and the NRC staff interpret the timeframe for the end of detection monitoring differently.

2 The NRC staff is in the process of further evaluation of the report on the site visit and the State of Colorado comments on the report to determine if there is a health and safety impact from the early termination of the detection groundwater monitoring. The staff will document its review in a letter to the State of Colorado. The staff stated that the staffs review should be completed by September of 2012.
